RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-05649 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His AF Form 911, Enlisted Performance Report (EPR) (MSgt thru CMSgt), rendered for the period 26 Aug 10 thru 1 Apr 11, be voided and removed from his records. APPLICANT CONTENDS THAT: His EPR, Block V, Overall Performance Assessment, should reflect an overall rating of “5” rather than “4.” In early 2010, he informed the group commander that having his personnel managing multiple Automatic Data Processing Equipment (ADPE) accounts/assets in five different buildings would have detrimental results. He suggested that a primary and alternate ADPE custodian be appointed in each building; however, his request was denied because the commander believed this should be the responsibility of his personnel. He received a short-notice deployment two-months prior to a Unit Command Inspection (UCI). He identified the areas needing improvement; however they were never fixed during his absence. Subsequently, the ADPE program failed during the UCI. He tried to fix the problems early on but received negative support from his commander. He requested an initial feedback session numerous times; however, his rater never conducted one. According to his EPR a performance feedback session was completed on 14 Jan 11; however, this is a false statement. In Jan 11, he returned from a six-month deployment; met his supervisor for the first time; and only worked in the unit until Mar 11. In support of his request, the applicant provides copies of AF Forms 911, EPR notice, Temporary Duty (TDY) orders and various other documents associated with his appeal. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving on active duty in the grade of master sergeant. On 11 Aug 14, the applicant was advised that the AFBCMR is the highest administrative level of appeal in the Air Force and that he should exhaust all other available avenues of relief prior to seeking relief through the AFBCMR. AIR FORCE EVALUATION: AFPC/DPSIDE recommends denial and states, in part, that the applicant has not exhausted avenues of administrative relief. In this respect, the applicant needs to submit an AF Form 948, Application for Correction/Removal of Evaluation Reports, with all required supporting documentation, through the vMPF/Evaluation Appeals found under the Most Popular Applications. The complete DPSIDE evaluation is at Exhibit B. APPLICANT’S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 19 Aug 14, for review and comment within 30 days (Exhibit C). As of this date, this office has not received a response. THE BOARD CONCLUDES THAT: 1. The application was timely filed. 2. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. In this respect, we note this Board is the highest administrative level of appeal within the Air Force. As such, an applicant must first exhaust all available avenues of administrative relief provided by existing law or regulations prior to seeking relief before this Board, as required by the governing Air Force Instruction. The Air Force office of primary responsibility has reviewed this application and indicated there is an available avenue of administrative relief the applicant has not first pursued. In view of this, we find this application is not ripe for adjudication at this level, as there exists a subordinate level of appeal that has not first been depleted. Therefore, in view of the above, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that he has not exhausted all available avenues of administrative relief prior to submitting his application to the BCMR; and the application will only be reconsidered upon exhausting all subordinate avenues of administrative relief.
